Location-Based Services Terms of Use

Article 1 (Purpose)

The purpose of these terms and conditions is to regulate the rights, obligations, and responsibilities of the company and the individual location information subject in relation to the location-based services provided by XTRION (hereinafter referred to as the "Company"), as well as other necessary matters.

Article 2 (Other Regulations)

Matters not specified in these terms and conditions shall be governed by the Location Information Protection Act, the Personal Information Protection Act, the Act on Promotion of Information and Communications Network Utilization and Information Protection, the Company's terms of use and privacy policy, and guidelines separately established by the Company.

Article 3 (Service Content and Fees)
  1. The Company provides the following location-based services by receiving location information from a location information provider:
    1. 1. GeoTagging Service: The location information of the individual location information subject or mobile device with mobility included in the post or content stored by the user is stored along with the post or content. The stored location information may be retained without separate utilization, or may provide a function to classify or search for posts based on the location.
    2. 2. Provision of search results and posts using location information: When requesting information search or providing location information of the individual location information subject or mobile device with mobility, search results using the location information may be provided.
    3. 3. Protection of users and prevention of unauthorized use: Attempts by unauthorized persons to use abnormal services are blocked by using the location of the individual location information subject or mobile device with mobility.
  2. The usage fee for paragraph 1 location-based services is free of charge.
Article 4 (Rights of the Individual Location Information Subject)
  1. The individual location information subject may withhold consent for a portion of the personal location information collection range and terms of use, or for some of the purposes of use/provision of personal location information, the range of recipients, or some of the location-based services.
  2. The individual location information subject may withdraw all or part of their consent for the collection, use, and provision of personal location information.
  3. The individual location information subject may request a temporary suspension of the collection, use, and provision of personal location information at any time. In this case, the company will not refuse the request and has the technical means to comply with it.
  4. The individual location information subject may request the company to access or notify them of the following information and to correct any errors in the information.
    In this case, the company will not refuse the request without justifiable reasons.
    1. 1. Confirmation of location information collection, use, and provision for the individual location information subject.
    2. 2. Reasons and contents of the provision of the individual location information to a third party based on the Protection and Use of Location Information Act or other laws and regulations.
  5. If the individual location information subject withdraws all or part of their consent, the company shall promptly destroy the collected personal location information and confirmatory documentation of location information collection, use, and provision. However, in the case of partial withdrawal of consent, it shall apply only to the personal location information and location information collection, use, and provision confirmation documentation related to the withdrawn consent.
  6. The individual location information subject may contact the company using the contact information in Article 13 of this agreement to exercise the rights set forth in paragraphs 1 through 4.
Article 5 (Rights of Legal Representative)
  1. If the Company intends to collect, use, or provide personal location information from a child under the age of 14, the Company must obtain the consent of both the child and their legal representative.
  2. The legal representative may exercise the right to defer consent, withdraw consent, temporarily suspend collection, use, or provision of personal location information, and request to view or be informed of the information collected, used, or provided regarding the personal location information of a child under the age of 14.
Article 6 (Basis and Retention Period for Location Information Collection, Use, and Provision Confirmation Data)

Based on Article 16, Paragraph 2 of the Act on the Protection, Use, etc. of Location Information, the Company automatically records the confirmation data for the collection, use, and provision of location information for the personal location information subject, and retains it for more than 6 months.

Article 7 (Change and Suspension of Services)
  1. If the Company is unable to maintain the service due to its own circumstances, such as changes in the policy of the location-based service provider or legal obstacles, it may restrict, change, or suspend all or part of the service.
  2. In the event of a service interruption under Paragraph 1, the Company shall give prior notice through the Internet or notify the personal location information subject.
Article 8 (Immediate Notification of Providing Personal Location Information to Third Parties)
  1. The Company shall not provide the personal location information of the individual location information subject to a third party without the consent of the individual location information subject, and when providing a third party service of information provision, it shall notify the individual location information subject of the recipient and the purpose of the provision in advance and obtain consent.
  2. When the Company provides personal location information to a third party designated by the individual location information subject, it shall immediately notify the individual location information subject of the recipient, the date and time of the provision, and the purpose of the provision through the communication terminal device that collected the personal location information.
  3. However, in the following cases, the Company shall notify the individual location information subject in advance to the communication terminal device designated by the individual location information subject:
    1. 1. When the communication terminal device that collected the personal location information does not have a function to receive text messages, images, or videos
    2. 2. When the individual location information subject has requested in advance to be notified to a communication terminal device or email address other than the communication terminal device that collected the personal location information
Article 9 (Purpose of Retaining and Using Personal Location Information, and Period of Use)
  1. The Company shall retain and use personal location information for the minimum period necessary to provide location-based services.
  2. The Company generally destroys personal location information after using it once or temporarily in most location-based services. However, in the case of services such as "GeoTagging" where the user posts or stores personal location information together with the posting during the retention period of the posting, the personal location information is stored together during the retention period of the posting.
Article 10 (Damages)

If the personal location information subject suffers damages due to a violation of Article 15 through 26 of the Act on the Protection and Use of Location Information by the company, the personal location information subject may claim damages from the company. In such cases, the company cannot evade its responsibility without proving that there was no intention or negligence.

Article 11 (Dispute Resolution)
  1. In case of disputes related to location information, if the personal location information subject and the company cannot reach an agreement or cannot have a discussion, the company may apply for mediation to the Korea Communications Commission.
  2. If the parties cannot reach an agreement through discussion, either the company or the personal location information subject may apply for mediation to the Personal Information Dispute Mediation Committee under the Personal Information Protection Act.
Article 12 (Business Information and Location Information Manager)
  1. The company's name, address, and contact information are as follows.

  2. The company has designated a location information manager to handle complaints and protect the rights of personal location information subjects during the service use process.
Supplementary Provisions
  1. This agreement shall apply on the 07th day of the 04th month of 2023.
  2. The previous terms and conditions that were in effect on the 07th day of the 04th month of 2023 shall be replaced by this agreement.
